Could i sue my docter??

Question:

i had a contraceptive implant put into my arm that was meant to stop hurting after a few hours, and after 2 weeks of agony i went to a different docter who told me i had a bad infection in my blood and skin around the area where the implant was put in. i was put on antibiotics which are bad for the imune system, and if it was left any longer it could have been serious.
could i sue the docter that put the implant in?... i really don't think she made sure it was clean enough. also i collapsed on the way out when i had it done. could this have been a co-incidence or was it because the implant was not put in properly?

You could try.

It might be difficult. Infection is a known complication of ANY procedure that penetrates the skin. If your doctor has discussed the pro's and con's of the contraceptive implant with you (and she's going to say that she has ... and maybe even that she's given you printed information about it - I know I try to discuss all of this with MY patients) it is hard to win a legal action against her. It might not even be her fault!

If it can be shown that your doctor has poor skills at performing this procedure and has infected a lot of people in this way, perhaps you could build a class action case.

You'd really need to talk with a lawyer, but I'm not sure that I like your chances of winning a suit.

I think you should defiantly sue your doctor. you also have the proof from the other doctor, which is great. Everything on your side. It could be coincidence, but it could also be because you lost your balance because of your new implant. Good Luck at suing!

I think it was because of the implant. I think it was the doctors fault. There is no possible way that it can be a coincidence when it happened a few minutes after the implant.

I dont know does 2+2=4. The day after if it had not stopped hurting you should have done something then. Infections can lead to loss of limbs or other such tragedy. You have been negligent, but caught it just in time. Now go and get your 2 million from that doctors insurance company.

The collapse is not related to the way it is put it, it is a vagal reaction that some people have (the blood pressure drops real low temporarily).

But the infection is different. There is a high probability that either the device was not sterile when it was put in or the device was put in using improper technique. You can certainly sue the doctor for that, any good attourney will be delighted to take on your case for a percentage of your damages.

have the 2ND doctor you went to, write out a statement for you. you need documented proof,that the 1st doctor was negligent.and once you have that written statement,talk to an attorney.good luck to you and i hope you feel better soon.
