Suing a doctor. tell me if i am able to do it.?

okay. so i was seeing this psycholgist for about 2 years. i was only there for my ADD. i started getting worse, and am now suffering from GAD, PTSD, Depression and ADD while i was going there. i used to be okay then stress caused all of this. he chnaged my medicated sooo many times. almost everytime i was there because they werent helping, but he was puting me on things that my school and other adults were saying a 17 year old should not be on. sleeping pills, anti-depressants, & concerta. he would always change the sleeping pills and anti-depressants only after like 2 weeks of me being on them. i was also seeing a counselor there. we switched places because we heard things about the psychologist, and went to a different place. we found out he is not allowed to perscribe me medication, and that he was signing a different doctors name, a doctor whom i have never even met before. is this a reason to sue this man?

Answers:
If you sued him in civil court, you'd have to prove that he hurt or damaged you in some way. Mental damages are very hard to prove, but not impossible. Many attorneys may turn it down, unless there is big money for them, but a small firm could possibly take the case, for less money. Of course you do not pay unless the trial is over and you win. A final thing about civil trials, the trial will talk all about how crazy you are so be prepared for that.

What is mostly to happen is a criminal trial. If they don't know about it already, call your local District Attorney's office and ask what to do. I think there is a hotline number in the phone book. A criminal trial is a good thing because you won't have to testify except that you were prescribed them. None of that crazy ****. And if he goes to jail, have a big party!

In either case, if you have prescription bottles save them in a safe place. Also get your pharmacy records, and medical records from his office through his staff. HIPPA laws say you are entitled to them. The will be evidence!

Criminal court is where you'll find the most justice I think, but go for the civil suit if you like. You are entitled. Don't be discouraged about finding an attorney. He or She is out there.

Oh my God, yes. Please do! That was an absolutely AWFUL thing for him to do. Not to mention, it's illegal. You can definitely win your case if you have proof of this. I'm so sorry that you trusted this man and that he did this to you and best of luck with sueing him.
I hate to say this, but this is partially your fault. The person you are seeing is a psychologist which means that they try to help with psychological problems but do not have a medical degree. In other words, the person you are seeing is in no way a doctor and has no right to prescribe medicine. Surely either you or your parents should have realized that. What you really wanted to see if you wanted medication would have been a psychiatrist.

However, this guy is sick for doing what he did and you should sue him nonetheless.
First off you should have been seen by a Psychiatrist a medical doctor trained to evaluate your problem and trained in proper use of meds...why did you go to a psychologist they are not medical doctors and they do not have authority to give meds. I am shocked at this story this person has committed a crime .I want you to gather all the facts and app and meds write and log everything and get yourself a lawyer who is trained in this field...good luck KARA
