I used to be a legal secretary for an attorney whose practice was mainly representing people in their Social Security disability claims. That was 13 years ago, and the average wait was about 1 1/2 years. It is much longer now--ridiculously long, in fact. However, having said that, ALS is a very serious disease, so you may not have to go through all of the appeals processes. Perhaps your claim will be processed correctly the first time. Much really depends on how intelligent and helpful the person who processes your claim is and also how detailed your doctor's reports are.

My advice--apply NOW. The longer you wait to apply, the more "back pay" you will lose, plus obviously the longer it will take for it to be processed. If your claim is denied once, hire an attorney immediately. Do not just choose the first attorney you find in the yellow pages. Do your homework. Some attorneys are better at this than others. Choose one whose practice consists mainly of handling these claims. And, if possible, ask around locally to see who else has used this attorney for this type of case.

If you hire an attorney, he/she will get 25% of your back pay from Social Security, plus administrative costs, like photocopying costs and charges they have to pay the doctors for the medical records. You will not have to pay the attorney anything up front.

There is no way of telling how long. I know one person who had 2 failed back surgeries, 2 heart attacks and congestive heart failure and it took him 6 years to get his disability. I know another person who has congestive heart failure, diabetes and renal insufficiency that was approved in 2 years. I guess it depends on what kind of mood the person reviewing your case is in.

It really is a crap-shoot. I am currently on disability and decided to get a lawyer to represent me because of all the horror stories I heard about the process. I got approved in a couple of months. I don't know if it was because of my lawyer or not. My illnesses are severe but not life threatening at this point. If I did have to do it again I would take my chances and not get a lawyer. You end up getting your back pay if you get approved, less a 6 month waiting period.
