How do I go about sueing my dentist when he fixed the wrong tooth?
Question:
After a terrible tooth ache I went to my dentist, he did xrays gave me antibiotics and some pain pills and sent me to another dentist to redo a root canal that I had done several years ago. Two weeks and $1100.00 dollars later I am starting the same tooth ache again. I asume the antibiotics have worn off and the infection is coming back. What can I do legally? I can't aford to just get nothing for the 1100.00 dollars. And now I have to go back to the dentist. I live in MO. and could really use some advice on this.thanks

If your general dentist took an xray, he probably found an abscess under a previously treated tooth (not unheard of). When he sent you to the specialist, he (the specialist) more than likely xrayed it also and agreed, and performed the procedure. Chances are, you needed that procedure, and it will be difficult if not impossible to prove TWO dentists wrong.
Even though you still have pain, chances are in a court of law the doctors will be able to prove their work via xrays and exam results.
I had a toothache, and reluctantly saw my dentist. I swore it was this tooth (points to back of my mouth). he ignored me, and fixed a totally different tooth. Pain was gone. I was experiencing pain transference. I thought he was nuts, but he was right in the end.
Oh, that dentist? Hes my husband. LOL
There are 10-15 percent of failure in Root Canal treatments even in non infected situations. your dentist has taken radiographs & is sure about the treatment plan .Why don't you reffer to that endodontist again, he shouldnt charge you for the re-treatment of the same tooth. your problem might be solved by simple occlusal adjustment, ( slight reduction of tooth hieght).
