Because if they wrote that it killed 100% of bacteria, then one person in a million could still be left with bacteria on their hands, get sick, and then sue them. So they say it's 99.9% effective so there's always a .01% chance of error so they can't get sued.
Some are just a little stronger than others. That's the real danger of hand sanitizers, the ones they leave behind are the only ones left growing. Soon you have only bacteria that are not killed by the sanitizer growing on you.
