well is the date wrong or not? if you aren't reporting the correct day, you'll look like you are trying to blame them for something that was just an accident. If it was really wet and that is why you fell, then it is their fault.
Yup.sure sounds to me like they ARE to blame! ;)
GOOD LUCK!
I presume you have a medical report from your GP or the hospital that you went to after your accident, have you? What date does THAT say on it?
I'm no solicitor but I know in some cases it's possible for someone to get off on a technicality - for example if you're given a ticket for a motoring offence and they put two letters or numbers of your registration number back to front or use a different one (a D for a 0 for example) then you can get that ticket nullified because it's not your car. However in this case you obviously had an accident and you have your medical report and a signed statement from the cleaner saying they had put no signs up. You might be lucky and be ok. Your solicitor would have told you if by being a day out you have screwed your case or not. My guess is not. However do you also have any witnesses to your accident? Those would obviously help your case a great deal otherwise how do you prove that your fall was where you claim it was? They could say that you slipped in the street or anywhere and how do you prove it was on their staircase? I'd say, once again, that cleaner's statement is crucial and can NOT be negated whether or not your date is a day out or not.
Finally yes, making the stairs/corridor wet from cleaning with no warning signs WOULD be negligent under health and safety as your appartment block is a public place until you enter your front door.
Anyway good luck and hope it all works out for you in court. In any legal situation, your solicitor is the best person to offer you legal advice but if you wanted a second opinion you could always ask another solicitor (although it's unlikely they would if you are already being represented) or your local advice centre might be able to offer you some advice.
Doesn't matter. This appears to be a bluff. Don't back down and continue to follow your legal advice. This has definitely been an open liability issue where you have suffered an injury and have every right for compensation. You are now seeing how difficult the other side plays and proves more why we need legal representation.
That seems typical you stick it out if the cleaner signed a statement then I would think you have a good case if you have proof and photo's fight hem and you should get something also ask to have a copy of health and safety that they have for cleaners good luck
They're just bluffing or being stupid. It may be that the cleaner always comes on one day, but that week she was too busy so came another day but didn't tell anyone.
Cases like these go and on with the other eide messing about. The usual get out they use is 'we have no record of this' over and over again.
Keep going and stick to your guns.
