There is this kid who is I think 12 maybe 13. He moved in with his aunt because his mom is a drug user and is in a court ordered rehab. This child needs health insurance through the state. The aunt has no legal guardianship. The mom won't take the steps to get insurance for her child. The aunt can't afford insurance for him. What steps can she take to get this kid some insurance. He would like to join sports in school but can't do it without a physical that she can't afford.

This is in Michigan. She has tried calling social services but they keep telling her it's up to the mom to take care of it. Any suggestions?

The aunt should ask for temporary custody from the mother or (if she refuses) go file for it at the courthouse. You should not need lawyer for this. If the mother is still in treatment they will have no choice but to comply with your request. This may also be an issue because without custody if the child gets sick, the aunt can not even take him to the doctor or seek emergency treatment. By the federal government all medical facilities must have permission by the parent or guardian to administer treatment.

Well, I'm going to tell you what I would do here in Ks. So, I'm not sure it will work there, but here goes. Have the aunt take the child to the local health dept. There I believe there will be some paper work to get the child on Healthwave. I'm not sure if you have that in Michigan. Also, the people that work there are very good at answering these kinds of medical questions. I'm not sure if you need to have any documentation to be a Legal Gaurdian or not. I would think that if the mother has given her consent for the aunt to watch over the child, that would be enough. Good luck! My heart goes out to this boy.
