I've often wondered about this.
We are always being told the health service (in the UK) can't afford to give everyone the treatment they need in a timely fashion - so litigation must inevitably make things even worse.
On the other hand, if you have suffered loss of health due to negligence - especially if that affects your ability to work/lead a normal life afterwards, you should in theory be entitled to some recompense.
The same thing applies to other public services like the police. Following a terrorism investigation, it seems likely that two London men are to sue the police. One was injured in the raid but the other as far as I'm aware was not. Given that many thousands of people are questioned and detained every year - and they don't receive compensation on release/dropping of charges - is this right?
My feelings are that compensation should only be due if you have suffered very significant injury or stress which has a permanant affect on your ability to lead a normal life.
