I wouldn't think so. Sometimes infections just happen and no one really knows the cause. Unless there was some sort of negligence on his part, there's not much you can do. Also, check the papers you signed, it usually mentions things that they can't be held responsible for.
no, because you sign a consent form before surgery that says theres a possiblity ANYTHING can happen , even death.
