What does a hospital have to do wrong in order for you to sue them?
Question:
Answers:
If its a case against a medical provider(doctor, nurse etc.), in order to successfully prove your case you need to prove several things.
First, that the provider had an obligation to take care of you (ie you were a patient of theirs).
Second, that they caused you harm.
Third, that the harm they caused you was due to something that was against reasonable judgement or standard practice (something that most other providers would not have done - in other words, they should've known better than to do whaterver caused you harm.)
Other Answers:
send someone home who is dying and then 20 minutes dye from what ever they think they never had or miss diagnose them or give them the wrong medication or do surgery to someone who don't need it
Somebody at the hospital has to mess up a connived story.
Give out confidential information to someone that wasn’t authorized to have it this is called a violation of HIPPA.
Gross negligence eg. wrong medical regimen for the wrong patient, wrong operation site for surgical patient, giving medical information about you without your consent ( but there are some exceptions about this) so on and so forth.
Im reminded of the man in Florida that had to have one of his legs amputated. They cut off the wrong limb. Then realized they did that and still had to cut off the right one. A man who was going to have only one now has none. That is worthy of a mid-eight-figure settlement if you ask me.
A couple of years ago I have to have a growth removed above my left eye. I was too medicated to do it so they had my wife write "Yes" above the eye that had the problem. We still have pictures of it. It was pretty weird. I mean it was obvious what eye had the problem but they wanted to be sure.
they have to negligence towards you health and or cause you harm, but on another level give you incorrect medical diagnosis.
