Hi Frank - if police departments, school systems, fire departments, boards of directors have all been sued, I'm sure there are occasional lawsuits against the health department BUT you'd have to have a lot of paperwork and a legitimate reason to back up a claim. It's more common for a tenant to sue a landlord over non-compliance with health department issues (toxic mold, leaky pipes, roofing problems, etc.) that present a serious health hazard to the tenant. You can always approach the ACLU and ask about it; they have a reputation for bucking the system.
