caring for elderly aunt?

shes in a home, she now wants to return home to her house, shes no fit state and wants to sign her house over to the dss to care for her-if she does this does it mean that none of the family get anythink from her estate in the future.please help somebody, ive been visiting her for last two years every week in care home, dont know what to do.care home costing £300 per week

Answers:
If she wants to return home, then there are many different agencies that can give her the care that she needs. The house will need to be adapted for her needs and could cost you allot of money. You could wait years for the DSS to pay for this, and as she is already in a care home they are more than likely to advice you that she stays where she is. Ultimately you really need to think about what is best for your aunt, if she wants to return home, and feels unhappy where she is you need respect her wishes. she could sell part of her home in order to pay for the services, but I don't think that she can sign over the house to the DSS.

Another way round this is to get your aunt to transferee the deeds to the house to another member of the family, so that she no longer owns the house, but still lives there. This way she wont have to sell the house to get the care that she needs and you will all get your inheritance. If she has savings, then she will have to use this to pay for the care, a small amount might be paid for by the DSS, but you really need to look into this in a lot more detail.
If your aunt is in no state to care for herself her only safe option is in-home care which can be very exspensive. As far as signing her home over, that really isn't an option. Perhaps where you live DSS will care for the elderly, though here they won't, you have to use your medicare. DSS can't take the house, or the things from the estate. If she wills her things to be given to the state, or makes no will at all, the state or government will get her money and assets.
