Question:
I was injuryed in 2000, had surgery in 2001, never fully recovered enough to work, I'm on social security since case closed as they told me that was all they could do for me, it was a nightmare! I lost everything due to them not sending cks on time to force me to settle, my lawyer did nothing, now I was just told by new Dr they didn't put in something to keep curve in my back, now my spine is straight, thats why I can't lay flat, sit too long, stand too long etc, can I re open case? can I sue the Dr? I'm so angry living on $800 month at 40 yrs old, dependent on boyfriend, they said they can't repair it since Dr did this, is it too late? any advice apprieciated
Answers:
I don't think you would be able to. Was the case settled? If so, I don't think so. You may have to put in a new claim stating with your Dr's notes that because of this earlier injury, your symptoms and condition have deteriorated due to the original injury. Something to this effect anyway. You will have to ask your Dr to get exact facts or ring the Workers' Compensation Board in your town. You might (if you are a member of one) be able to get some support from your union.
Hope this helps - e-mail and I will try to help you further
xx K
i believe you can reopen the case.good luck...
