describe how the patient doctor relationship is contractual, how it is created, and whether it can be created through actions of the person answering the phone at a medical office?

Answers:
It's contractual in that you are paying a doctor for his services and are entitled by law to privacy. It's created when you expressly state that you want him to help you. It cannot be created by a secretary or assistant because they are not qualified.
More patients die than doctors, and patients pay for this privelege.
