A malpractice question.?

A few months ago I was in an accident and suffered serious injuries. During my month long recuperation in the hospital I had to wear a neck brace. After a week they took it of however after I informed them of some pain in my neck they put it back on. Nearly the whole time I was there I was in that neck brace and when they finally took it off I had an underbite(which i did not have) and recent photos have shown that my jaw is jutted out which it has never done before, though I suffer only constant mild discomfort I am tired of it, Can I have the hospital fix my jaw which they messed up in the fist place for free? If not would I have a suit against them for malpractice? I was released in Dec of 05 so it has been almost two years but the pain has continually began to increase. Before I was able to will it away but now that its bigger I might start needing to take asprine for it.

Unless you specifically told them that your jaw was hurting from the neck brace being on, and then they continued to leave it on anyway, then you dont have an argument.

You need to contact the hospital administration to ask these questions you have. They may have recourse for the end result from your injuries. They may be able to correct it as part of your injuries.

However, there should be no way that your jaw would completely change its structure permanantly based upon a month of wearing the brace.

You may be able to visit a dentist, explain what happened, and get it corrected pretty easily. I dont see how wearing a brace for 30 days would make your jaw stay like that permanently.

Bottom line...talk to the hospital administration and consult your physician. Explain to your physician that you never had this problem before and it seems to be directly related to your stint in the hospital with the brace.

Unless they know about it, they really cant start trying to fix it.
Dude, you're lucky you aren't dead. Just be glad that the hospital was able to put you back together. Some way to repay them for it.
You had a hard collar or a soft collar? I find it hard to believe at all. I've worked in a hospital for almost 30 yrs(ouch!!) and have NEVER seen ANYTHING like this related to a neck collar. I'm sure you'll find some bottom feeding lawyer to push this nonsense somewhere hoping for a out of court settlement. Since it's cheaper to pay than to fight BS lawsuits like this.
