My son got bit by a dog, and my FIL is turning it in on his insurance for pain/suffering. Will that work?

My mother in laws dog bit my ten month old son on the ear and arm sunday, and my father in law is turning it in on his home owners insurance (the dog is covered) and trying to get pain and suffering money. I was just wondering if they would get anything out of it.

I have received pain and suffering money from a car accident, I think you are saying YOU will be getting the money? Can't see as THEY suffered pain and suffering when THEIR dog bit YOUR son!

Second, was he injured to the point of requiring medical attention from professionals (not just band-aids from you)? If not, it will be really hard to get pain and suffering.

Third, his rates will go up or he may even be dropped by his insurer. Can't imagine it's worth it..
as far as i know they wont but it sound like you might and they might be doing it so that maybe they can get either some or all the money out of it. Does your son have a current tetenis shot? if not you should take him in for one..
It honestly depends on what he wants to get.

Many states will not allow one to sue for pain & suffering. If he is in one of those states he is out of luck.

Secondly if it is his insurance they are going to drive his rates through the roof for him having a violent dog.

This might even be considered fraud.
