You can talk to your local Health Dept and they will force landlord to clean it up. I would also try the EPA in your area. It is really illegal in most places. Had a cousin with same problem and it got them out of their lease and forced landlord to comply with Health Dept guidelines. Very serious issue. Mold can cause a lot of problems with your health. Do what you have to do to keep yourself healthy.
Sick building syndrome is very rare.....and very difficult to prove. You will have a very difficult time blaming the landlord. It will take an epidemiologist, competent in environmental work, to evaluate the situation. Be prepared to be told there is no problem. And, most likely there isn't anything happening that is due to negligence.
I lived in a rat trap way back. Had the same problems. Got very ill. Developed chronic, severe migraines, chronic respiratory infections, and felt awful 95% percent of the time.
Being somewhat healthy before I entered the apt-I started looking toward my environment. I took me a little while to figure this out since we moved in the summer and all of the sudden- in the winter (when the windows were closed), I got very ill with the above listed problems.
Back then-I looked into what I could do...and here's what you can do...Call the local home inspector-have him come out and check it. He will force the landlord to fix the problems or condemn the building. When the local inspector comes and sees the mold and what ever other problems there are-you will be able to get out of your lease.
Move out, if possible.
If moving out is not an option I would suggest a good quality HEPA filter and put it right by your bed. I would put another one in any other room you spend a lot of time in. If you have children in the house-get a HEPA filter in their room-mold can seriously mess with them. Keep all of the windows open as much as possible!!!
When I was in the same situation-I wanted to sue too. But it isn't worth it. I think trying to sue the landlord would be a very expensive and fruitless act. You could be out a lot of money.
Just get out of the place ASAP. Call the health/home inspector and have your landlord shut down.
