Should patients have the right 2 sue their doctors, even though the risks r known about Gastric Bypass?

if the doctor didn't warn the patient about these complications and there is proof of this then yes...sue away. however if the doctor informed the patient as they always should and the patient decides to take that risk then sueing the doctor afterward should just NOT be an option. it was your choice, you took your chances now live with it. there is something very wrong with people in this country. people are always wanting to sue for every little mistake no matter what. they are rediculous not to mention they waste MY TIME when i get called in for jury duty.

I think the patients don't have a right to sue their doctors for gastric bypass. They are told the specific risks and most likely sign a consent form stating that they know these risks. It's just like the people that sue McDonalds because THEY ate too many Big Macs...
,it depends if the doctor screw up performing the operation, if he did of course he needs to be sued, if not and you just changed your mind or whatever then no
no because you made the decision for that surgery and hopefully were told of the risks. i know that there is much counseling done before that type of surgery to make sure you understand what will happen
No, and they shouldn't be allowed to sue for so many other reasons either. Everybody is so sue-happy these days that good, honest people are being run out of business. Everyone's trying to make a buck.
If you signed an informed consent paper, which you most likely did then you have no grounds. Unless you can prove that the doctor did something during the surgery that was not supposed to be done.
If it is doctor error then absolutely.A friend of mine died Oct 16th after having a lap band procedure on the 12th. The doctor while stitching her closed perforated her intestines and she developed peritonitis. The doctor was called on Numerous occasions thru out the weekend only to say that her symptoms were post op. He even refused to come to the ER on Sunday night when she went because of the pain. She died on Monday morning leaving behind a 6 yr old son. Should he be sued?
YES.. My cousin had this surgery and the doc messed up and actually cut through her esphogus. Did not catch it in time or listen to her when she came back very ill. She went to another hospital which found the problem but by that time her whole body was infected. They tried DOT save her, she slipped into a coma and died a bout a week later. She was only 41. Her doc talked her into the surgery to try and help her diabetes. Huge lawsuit has been filed by her children, tehy are 19, 16, & 5.
