Can i sue my orthodontist for his unfinished work?

Question:

its been 2 years and 2 months since i had it on and my teeth are gradually getting straight... i needed braces because my teeths were overcrowded due to my small jaws and so i had to pull out 4 teeths prior to getting my braces... so i did and it is getting better... BUT the thing is my alignment is not good..my left side is nice but i cannot bite down on my right side because it seems like the lower jaw is shifted more to one side and and my bottom teeth is still crooked and its hard to explain it but its prettyy noticible..and my ortho is saying he is going to take off my braces KNOWING that its not finished, and his reason is " THIS IS ALL I CAN DO.. NOT EVERYONE'S TEETH IS PERFECT" wtf? and i consulted a different orthodontist and he said it is FIXABLE so is it possible to sue my ortho for his unfinished job?? i really dont know what to do... if i can get partially my money back, then thats all i would ask for.. but if he says he cant do that, then can i sue him? please help me!

If he said that's all he can do maybe it's all he can do. Did the other orthodontist look at your teeth and say I can fit your teeth maybe you should go to him. However, I'm not sure in the term of suing him after two years. You may not win your case because you waited so long and he did give you braces for the money you paid. Maybe you should ask someone in law part of YouQA.com or call a lawyer.

OMG, first of all (obviously), you had a really bad and dishonest orthodontist!
I don't see anything wrong with sueing your so-called-ortho about the unfinished job and the disloyalty. I mean, you pay him to get your teeth straight and it's not cheap.
What I would do is ask for some of the money back, and if they don't give you it back, go ahead and sue them.
You have the right to sue them because what they is sooo wrong.
I feel so bad for you and I'm so happy that you found a different ortho.

Wow... that is pretty bad. With technology these days, there aren't many cases that can't be fixed. I work in a dental office and I have seen some pretty bad cases turn out great with ortho. These things just vary in the difficulty of fixing the problem. It seems that your orthodontist feels that this is out of his expertise, though it is so unprofessional for him to take your money and leave you like that. I am pretty sure u have a case for a lawsuit if he is not willing to refund your money. I think the right thing for him to do would be to give back some of your fees and refer you to an orthodontist or other specialist who CAN fix your problem. Having an open bite will cause many problems down the line and he should know that. Write a harsh letter to him and try to work things out first. If he is uncooperative, then file a claim againt him. It may also help if you have the other orthodontist that you consulted write to him stating what could be done to fix the problem. Good luck!

IF YOU CAN HAVE A WRITTEN STATEMENT FROM THE SECOND ORTHO SAYING THIS CAN BE FIXED, THEN YOU MAY HAVE A WINNABLE CASE. SEE AN ATTORNEY AS SOON AS YOUR BRACES ARE OFF.
