Answers:
Malpractice is doing something you shouldn't, intentionally. So, it is not malpractice. It isn't negligence either which is not doing something you should. It's a simple accident. The instruments used in root canals are very fragile and delicate. I work for an endodontist, I know.

If you're worried, go see another endodontist and see what he/she tells you. Seriously though, it isn't malpractice.
I would question the dentist, ask to speak to another dentist if there is one available. If you still feel uncomfortable then go see another dentist. It's your mouth and you should know what's going on in there.

As far as malpractice, I'm not sure what you could do. If the broken instrument poses a problem, the original dentist should remove it with no charge. If not, then you might have some kind of court case. I would be more concerned on getting my mouth ok again before I do any of that.

Hope this helps! :-)
If she said it's going to be fine, then it should be fine. This is why I make our patients sign a consent form before we do a root canal on them, so that way they are explained of what "could" happen. This happens often and there's not much that can be done about it. You need to understand that they are using tiny little instruments in a very small space. These instruments are man made and being used by a another person so there is always a chance of something going wrong. Think of it this way, instead of that small area being filled with the rubber material, it's now filled with titanium steel. Cool.
If anything broke off into a canal it is a file and no its not fine it needs to even come out so she can finish the endo treatment ,after filing down the canals the dentist fills the canals with a rubber material to seal them, then if the tooth does fine after a time period you will get a permanament filling.
not malpractice.

If she didn't inform you about it, then it may be considered.

Files breaking is common. If the nerve was removed prior to the breakage, you may be okay.

If you go in a get it out, it will take more work, your tooth may be damaged during the retrieval, and your teeth may crack.

Leave it alone if she says so.

Or, go to a specialist, endodontist, and get it evaluated.
